These general terms govern access and use of the website www.destinosinteligentes.es, which SEGITTUR makes available, free of charge, to Internet users, as well as access to and use of the information relating to any of the products and services contained therein. Access to the same implies full and unreserved acceptance of each and every one of the provisions included in this Legal Notice in the version published by SEGITTUR at the time the User accesses the Portal. Consequently, the User must read this Legal Notice carefully each time they intend to use the Portal, as it may have undergone modifications since their last visit.

The services offered on by SEGITTUR on the Portal are, in the main, and unless stated otherwise, free of charge. Notwithstanding the above, some of the services provided by third parties through the Portal may be subject to the payment of a fee, in which case the conditions set by such third parties for the provision of their services shall apply.

Access to the services supplied through the Portal does not generally require prior subscription or registration by the Users; without prejudice to the fact that access to certain services may require the User to register first.

The User guarantees that the information supplied when registering for the services requiring User Registration is true and authentic, and is obliged to keep this information updated. The User undertakes to respect the intellectual property rights of SEGITTUR and/or third parties, and to this end, shall refrain from reproducing, copying, distributing, making available or any other form of public communication, transforming or modifying the content, unless authorised by the owner of these rights, or if it is legally permitted to do so.

The User undertakes to use the Portal and services in accordance with the law, this Legal Notice, the Special Terms for certain services, and all other notices, rules of use and instructions of which he or she is made aware, and in accordance with standards of decency, generally accepted customs and public policy.

To this effect, the User shall refrain from using any services for illicit purposes, whether prohibited under this Legal Notice, pernicious to the rights and interests of third parties, or that in any form may damage, render useless, overload or prevent normal use of services, computer equipment or documents and files and any type of content saved to any IT equipment at SEGITTUR or other Internet Users (hardware and software).

6. Consists of either illegal, deceptive or unfair advertising, and in general, constitutes unfair competition.
7. causes disruption to the normal operation of the service, due to the nature of characteristics of the information.

The User also agrees to use the content made available to Users on the Web Portal, this meaning, and this list is non-exhaustive, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sonic content, as well as graphic design and fonts (hereinafter “Content”), in accordance with the law, this Legal Notice, the Specific Conditions for certain Services and other notices, conditions of use and instructions made known, as well as with morality and generally accepted good customs and public order.

• Analysis and/or verification mechanisms.

Some of the pages of the Smart Destinations portal feature analysis and/or verification devices in the form of cookies, which are small data files generated on the user’s or customer’s computer when they browse the Portal’s websites and pages. The cookies that may be used on the websites and web pages of the Portal relate solely to the browser of a specific computer (an anonymous User), and do not in themselves provide the name and surname of the User and allow our systems to remember the language and portal chosen, as well as other characteristics or browsing preferences of the user in their first session. These cookies are not invasive or harmful, and nor do they contain personal data, as their sole function is to personalise your browsing experience as described above. The User may configure their browser to be alerted on screen of incoming cookies and to prevent the installation of cookies on their hard drive. The cookies which are used at the sites and pages of the Portal may be served by SEGITTUR, in which case they are served from the various servers operated by SEGITTUR, or by the servers of specific third parties who provide SEGITTUR with services and serve cookies through TURESPAÑA (such as, for example, those used in order to serve specific content and which let the User view this content according to predetermined forms, times and number of occasions).

Users who wish to set up a hyperlink between their website and the Smart Destinations Portal must meet the following requirements:

1. Doing so may not cause confusion to other potential users as to the origin and ownership of each of the web pages. The hyperlink will allow access only to the Portal’s home page, but may not reproduce it in any way, and will not create a frame on the web pages of the Smart Destinations Portal.

• To manage requests for information made through the contact form on our website (www.destinosinteligentes.es) or contact email (destinosinteligentes@segittur.es).
• To include users in the contact list upon joining the Smart Destinations Network.

• To send commercial information from collaborating members of the SD Network.
• To manage, through the “User access” platform hosted on our website, interactions with members of the SD Network.

• Exclusion of liability and warranty

1. For the functioning, content and services of the Portal

SEGITTUR does not guarantee the availability and continuity of the functioning of the Portal, its services and content. Therefore, under no circumstances will it be responsible for harm or prejudice of any kind that could result from the lack of availability or continuity of the Portal or any of its services, or from failures in access to the different pages of the Portal or to those pages offering specific services.

The Portal offers users technical link mechanisms, directories and search tools (such as, amongst others, links, banners, etc.), which allow access to web pages and sites belonging to and/or managed by third parties, with the aim of allowing Portal Users to search for and access information, content and services available on the Internet.

The results of technical linking devices, directories and search tools are provided directly by third parties and result from the automatic operation of technical mechanisms.
